| Linn-Moore can not render employment or tenant services to any client who does not comply with federal or state employment opportunity or tenancy laws and regulations. All clients must certify in writing to such compliance before Linn-Moore will initiate work on their behalf. Linn-Moore will also not conduct any employment or tenant investigation utilizing personal information supplied by anyone other than the consumer (applicant) in writing. Background reports used for making hiring decisions are considered consumer reports and the companies that sell them are considered consumer reporting agencies (CRA's). These reports and the companies that produce them come under the jurisdiction of the Federal Trade Commission ("FTC") and as such, are regulated by the federal Fair Credit Reporting Act ("FCRA"), which governs the access to and use of the information that make up a consumer report. As a CRA, all work performed by Linn-Moore will be done in compliance with applicable federal disclosure and privacy laws, such as the FCRA, and other Acts such as the Gramm-Leach-Billey Act, Age Discrimination Employment Act, Right to Financial Privacy Act and the Driver's Privacy Protection Act. Accordingly, obtaining information for inclusion into a background report requires written authorization from the subject ("consumer") of the report. If notified of any adverse action based on the content of a report, the consumer must be given a copy of the report, a Summary of Rights form and be afforded the opportunity to dispute any information contained within the report. As allowable by the FTC, Linn-Moore will act on its client's behalf by managing FCRA required consumer notifications and any dispute processes initiated by the consumer. Linn-Moore will keep its clients informed of any issues relating to the FCRA, the single most relevant law affecting both the providers of background reports and their clients who use them. |
